Terms and Conditions:

We will take all practicable steps to identify and minimise potential dangers. However, you must follow our instructions at all times and observe the advice presented in our Rider Briefing.

 

You the hirer agree to release or indemnify the Owner and our staff against any liability we incur to anyone
else, resulting from your failure to follow our instructions.

 

We reserve the right to withdraw the rental motorcycle, from any person who in our opinion is likely to endanger themselves or others. We also reserve the right to cancel the hire agreement at any time if we become concerned for any reason for your safety or that of any other person.


PLEASE NOTE: Under New Zealand law it is not possible to sue anyone for personal injury. New Zealand’s Accident Compensation (“ACC”) scheme provides only limited assistance to visitors to New Zealand who are injured.

 

If you are not resident here you should have full insurance covering any injury you might suffer, including medical treatment cover, before riding a motorcycle in New Zealand.

We also recommend that you should have a comprehensive travel insurance policy in place.

 

EXCLUSION: To the extent permitted by law, all our liability for damage to your property, disruption to travel plans, or mental injury is excluded. This exclusion is subject to any rights or remedies you may have under the Consumer Guarantees Act 1993.


INSURANCE DECLARATION: The hirer declares that he or she is over the age of twenty five years and has not been convicted in a court for any criminal offence or for driving under the influence of Alcohol or drugs.

Insurance Details

 

1.The hirer is automatically covered, as part of the daily hire charge, with a comprehensive insurance cover.

 

2.A standard excess applies in the event of theft or any damage to either the motorcycle or third party property; Excess is $2500 (+$1000 for 21 to 24 year old )

3. A security bond equal to the chosen insurance excess amount is taken on the signing of this agreement by way of a signed acknowledgement in this agreement. This may include and authorised hold on the card for the amount of the excess, pending any future
liability.

4. By signing this agreement and entering your credit card details the hirer agrees that they are liable for any accident damage or loss to any third party up to the amount of the excess described above. The owner also holds these details to cover any damage to accessories, traffic fines and tolls that may be incurred by the hirer. This also covers keys and any top-up fuel where the motorcycle is returned with less than a full tank.

5. If the motorcycle, accessories or any third party has suffered damage or loss the owner will make an assessment of the monetary value of such damage or loss and, under advice to the hirer, will deduct this value from the hirers credit card if this is can be assessed at the time the motorcycle is returned to the owner. In the event that the quantum of any damage or loss cannot be determined at the time the motorcycle is returned to the owner the full amount of the excess will be charged to the hirers credit card, plus any cost of recovery of the motorcycle.

6. Therefore the hirer’s maximum liability is capped at the amount of the excess described in insurance options 1, 2  & 3, plus any cost of recovery.

Insurance cover is voided, and the hirer is fully liable for all costs, if:

​

1. Any of the terms of this agreement are breached including making a false insurance declaration.
2. Damage to property is caused by careless, wilful or reckless driving including whilst the rider is under the influence of alcohol or drugs.
3. Damage to property is caused by submersion in water, such as river crossing, including salt water, resulting from rider negligence.
4. Damage to property is caused by riding off formed roads (eg cross country) or on roads which are not public or legal roads.
5. The rider’s licence is invalid, not current or not appropriately rated for the motorcycle.
6. The motorcycle was being ridden in an unlawful manner, such as on the right-hand side of the road.

ACCIDENTS

1. If the hirer has an accident which may or may not involve damage to a third party, telephone contact must be made immediately with the
owner.

 

2. If the motorcycle has minor damage and can be ridden safely and legally then the owner will authorise the hirer to take the vehicle to the
nearest garage where an assessment will take place by a qualified mechanic. There is no obligation on the part of the owner to cover any
costs incurred by the hirer other than the repair of the motorcycle.

 

3. If the motorcycle is extensively damaged and or unable to be ridden legally then the agreement can be terminated at the owners sole discretion. There is no refund on the rental or any monies paid, and the insurance excess will be charged to the nominated credit card pending all costs associated with the repair and the recovery of the motorcycle being full concluded. Any rental accessories must be returned by the hirer to the owner at the hirer’s cost. If the hirer wishes to enter into a further rental agreement for a replacement motorcycle such agreement will be on fresh terms and conditions as if it was a new agreement with all hire costs payable by the hirer. The owner is under no obligation to enter into a new agreement.

4. The hirer is responsible for all costs associated with arranging and booking alternative transport for the remainder of their travel within New Zealand. There will be no expectation that the owner will arrange or provide replacement transport or be liable for any other travel or holiday costs.

 

5. These provisions apply regardless of the cause of the accident or whose fault it was.

REPAIRS
1. If the motorcycle requires a mechanical repair during the hire period, such as a broken light, cable or electrical fault, the hirer may have
repairs carried out up to the value of $100.00 without authorisation from the owner.
2. The owner will reimburse such costs of repairs provided receipts are produced.
3. For any repairs costing over $100.00 the hirer will contact the owner for prior approval.
4. If the hirer suffers a puncture the hirer will repair or have the tyre repaired, at the hirer’s cost, without recourse to the owner.

 

OTHER OBLIGATIONS OF THE PARTIES
The Hirer will:

 

1. Not permit any other person to ride the motorcycle.
2. On or before the expiry date of the hire deliver the motorcycle to the owner’s depot as detailed in this agreement.
3. Take all reasonable care in handling and parking the motorcycle.
4. Not ride the motorcycle on any beaches, through salt water, on non public, non legal roads or off formed roads (e.g. cross country). This includes, Ninety Mile Beach (Northland), Oreiti Beach (Invercargill), Skippers Canyon (Queenstown), Nevis Road, Bannockburn to Clyde Pylon track, Mavora Lakes Road and Mt Nicholas Road to Lake Wakatipu.
5. Securely lock the motorcycle whenever it is left unattended, by using the ignition lock.
6. Keep engine oil above minimum level, chain lubricated daily, and tyres kept at proper pressure.
7. Check the engine oil level every 1000kms.
8. Not allow more than one pillion (two-up) passenger which defeats the Certificate of Loading maximum.
9. Notify the owner immediately when any significant damage occurs to the motorcycle whether or not it renders the motorcycle un rideable, Stone chips, scratches and puncture repairs are not considered significant damage for the purposes of reporting these to the owner before the end of the hire period.
10. Not sublet or hire the motorcycle to any other person.
11. Not operate the motorcycle, or permit it to be operated, while under the influence of alcohol or drugs.
12. Not operate the motorcycle, or permit it to be operated, in any race, speed test, rally, organised event, or contest, or to propel or tow any other vehicle.
13. Not operate the motorcycle, or permit it to be operated, in breach of any legislation of bylaws relating to road traffic.
14. Be familiar with, and understand, New Zealand’s driving rules before the hire period commences..
15. Not allow anyone to perform any type of significant mechanical repair or work on the motorcycle beyond minor maintenance such as
tightening cables, chains, mirrors or bolts using the on-board tool kit, unless they are a certified mechanic or approved by the owner.
16. Not hard wire any electrical accessories to the electrical system.
17. Not attach any personal accessories to the motorcycle such as GPS units or Go-pro cameras.
18. Keep one copy of this agreement available throughout the hire period for producing on demand to any police officer.
19. Accept responsibility for all traffic violations and or toll road charges. A $25 administration fee will apply for any unpaid fines, tolls, or to delayed process of infringement.

 

The Hirer is liable to pay for:
1. Fuel topped up to return the tank to full at the completion of the hire. Minimum charge $25.00 if not topped up.
2. Any parking or traffic fines. If the hirer has presented a charge card for payment, all charges including parking infringements and speed
camera fines, toll road charges, may be billed to the charge card and the hirer’s signature on this agreement authorizes this charge.
3. The replacement cost of any lost or damaged, keys, tool kits.
4. The cost of repairing any punctures or replacing damaged tyres, which are not subject to insurance cover.
5. An amount equal to all other costs, expenses, claims, demands and penalties incurred or otherwise resulting from the use of the motorcycle
and accessories by the hirer or by any other person during the period during which the motorcycle is hired by the hirer, beginning at the time of delivery of the motorcycle to the hirer and ending at the time when the motorcycle is returned to the owner.
6. The full hire charge applicable for the duration of the hire as documented on this agreement, despite any early return of the motorcycle and accessories at the discretion of the hirer.
7. All charges under this agreement are payable on demand, such demand for payment usually being made at the expiration of the term of the hire but some demand may be made later to cover costs and expenses which are subsequently determined.


The Owner will:
1. Supply the motorcycle in a safe and roadworthy condition.
2. Have the right to terminate the hire and take immediate possession of the motorcycle and accessories if the hirer fails to comply with any of the terms of this agreement, such termination being without prejudice to the other rights of the owner and the hirer under this agreement or otherwise.
3. Provide no warranties, except to the extent required by law, to the hirer in respect of the motorcycle or accessories and excludes all implied warranties where that is lawful.
4.Accept no responsibility or liability, except for its obligations under this agreement, for any costs, expenses, damages (including any damages for loss of enjoyment) or any other liabilities resulting from any damage to the motorcycle or accessories (whether accidental or otherwise), breakdown or any other failure of the  motorcycle or accessories, irrespective of whether the owner was in any way negligent.
5. Not be liable to the hirer nor to anyone claiming through or under the hirer for any indirect, special or consequential damages arising in any way out of any matter covered by this agreement.

Notes:
• Remember to lock the bike when left out of sight day or night with steering lock.
• Tyre pressures are 42psi (3 bar) Rear 36psi (2.5 bar) Front (Single) adjust slightly for pillion.
• Use 91 unleaded fuel unless otherwise advised
• Please check the oil. The oil is 10/40w Semi Synthetic. The motor must be at running temperature before checking on the centre stand.
• Please ensure the chain is well lubricated.
• Always observe the speed limits.
• Ride on public roads only. You are not insured for private roads beaches or tracks,

During weekends the depot will only be open 30 minutes prior to your pick up or drop off.
